The 2026 Finance Law extends the income tax exemption to certain supplementary pensions paid by the Caisse Interprofessionnelle Marocaine de Retraite. The measure targets benefits arising from collective group supplementary retirement insurance contracts, and not individual contracts as a whole.
Essential conditions
Contributions must have been withheld at source by the employer and deducted from taxable salary in accordance with article 28-III of the General Tax Code. That deduction is tightly framed: the contract must in particular run for a minimum term of eight years, and benefits must be paid from the age of 45 onwards.
The circular excludes individual contracts, even where the employer has contributed to funding them. Nor does an individual payment made into a collective contract automatically qualify for the exemption. Benefits paid before retirement remain taxable.
In practice
The CIMR must continue to report all benefits, whether exempt or taxable, and to withhold income tax on taxable amounts only. For a retiree, the classification of the contract and the history of contribution deductions therefore become decisive.
Before concluding that the exemption applies, it is useful to obtain a certificate stating the collective nature of the scheme, the contribution period and the nature of the benefit. Where a taxpayer receives only exempt income, no annual return is required; other income may nonetheless keep that obligation in place.
