The 2026 Finance Act harmonises the treatment of instruments relating to loans granted by credit institutions and similar bodies governed by law no. 103-12. Instruments recording the release of funds are exempt from registration duty.
Securities concerned
Guarantee deeds, mortgage grants and pledges established as security for these transactions, together with the corresponding releases, are now subject to a single fixed duty of 200 dirhams. The aim is to eliminate differences in treatment based on the nature of the lending institution or of the ancillary instrument.
Security over movable property recorded by private deed remains, for its part, subject to optional registration. The characterisation of the instrument and the identity of the lender must therefore be checked before applying the fixed duty.
In practice
For a property borrower, this measure concerns the tax aspect of registering the security and its release. It does not remove the other costs that may arise: fees of the professional drawing up the instrument, land registry charges, bank fees or disbursements.
When a loan is repaid in full, the bank's release must still be formalised and then recorded with the ANCFCC for the charge to disappear from the land title. The fixed duty of 200 dirhams therefore does not, on its own, remove the mortgage from the register. The full chain should be checked, from the bank certificate through the release deed, registration and filing with the land registry.
